GENERAL ITEMS

9. APPROVAL FOR SCTI TO INCREASE GED TEST FEES
Description

Effective September 22, 2008, the Florida State Board of Education approved an amendment to rule 6A-6.021, Florida Administrative Code, regarding State of Florida High School Diplomas that will allow GED Testing Sites to increase student fees.

SCTI will increase their fees starting January 1, 2009 to the following:

10. APPROVAL OF THE MEMORANDUM OF AGREEMENT: IN NEW MEXICO HIGHLANDS UNIVERSITY SCHOOL OF SOCIAL WORK
Description

Approval of Memorandum of Agreement in New Mexico Highlands University School of Social Work.

The Memorandum of Agreement is a joint agreement to provide practicum instruction and supervision for NMHU Students.

11. APPROVAL OF AGREEMENT WITH COASTAL AUDIO VIDEO
Description
This agreement will allow for non-paid career technical work experience for Exceptional Student Education Students from North Port High School 18 years or older in 11th or 12th grades to learn the day to day business operations at Coastal Audio Video.

Recommendation
That the School Board approve the agreement between the Vocational Instructional Program and Coastal Audio Video, as presented.

GRANTS

12. APPROVAL OF THE BEST BUY TEACHERS AWARD GRANT APPLICATION TO BEST BUY FOUNDATION FOR PHOENIX ACADEMY
Description
COMPETITIVE:  Grant funds in the amount of $10,000.00 (gift card) will be used to purchase new equipment such as digital cameras/camcorders, tripods, and other video equipment to enable students to participate in depth in a digital storytelling project.

Recommendation

That the School Board of Sarasota County approve the Phoenix Academy Best Buy Teachers Award grant application.

EXPULSIONS

13. APPROVAL OF EXPULSION CASE NO. 08-218
Description

The student listed in Expulsion Case No. 08-218 is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On February 1, 2008, the student listed in Expulsion Case No. 08-218 violated School Board Policy 5.34, Prohibition Gang Related Fight.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until December 19, 2008.



Recommendation

That in accordance with provisions of Sections 1006.07 (i)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-218 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately until December 19 of the 2008-2009 academic year.

18. APPROVAL OF EXPULSION CASE NO. 09-029
Description

The student listed in Expulsion Case No. 09-029 violated School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles, and School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 15, 2010.



Recommendation

Description

Description

Description

The student listed in Expulsion Case No. 09-047 violated School Board Policy 5.32, Threat to another Student.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until October 4, 2009.

22. APPROVAL OF EXPULSION CASE NO. 09-046
Description

The student listed in Expulsion Case No. 09-046 violated School Board Policy 5.32, Zero Tolerance.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 15, 2010.

MATERIALS MANAGEMENT

23. APPROVAL TO AWARD BID #9069 FOR HVAC TRANE FACTORY CHILLER SERVICE AND OEM PARTS
Description
Bids to provide 'HVAC Trane Factory Chiller Service and OEM Parts' were received from two vendors on October 2, 2008.  The bid of Tampa Bay System Sales, Inc., dba Tampa Bay Trane was the best low bid meeting the advertised specifications.  The bid of Hill York Service Corporation was non-responsive to the requirement to provide a corporate letter from Trane indicating that they are an authorized agent of and marketer of commercial/industrial HVAC products and services for the manufacturer.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the capital budget allocated to the Facilities Services Department.

Recommendation

That the bid of Tampa Bay System Sales, Inc., dba Tampa Bay Trane, to provide 'HVAC Trane Factory Chiller Service and OEM Parts' in an amount not to exceed $500,000.00, be approved for award and purchase.

FACILITIES

24. ACCEPTANCE OF SUBSTANTIAL COMPLETION FOR THE EMMA E. BOOKER ELEMENTARY SCHOOL - MDF ROOM RENOVATIONS PROJECT
Description

The project manager has prepared the Certificate of Substantial Completion and the final punch list.  The project is substantially complete in accordance with the contract documents.  



Recommendation
That the work performed by Jon F. Swift, Inc. for the Emma E. Booker Elementary School - MDF Room Renovations project be accepted as substantially complete as of 8/4/2008.

25. APPROVAL AND/OR RATIFICATION OF THE FACILITIES SERVICES CHANGE ORDER(S)
Description
The Facilities Services Change Order(s) have been summarized on the enclosure for ease of review.  These change order(s) collectively total an increase of $5,574.28 in contract amounts. 

Recommendation
That the Facilities Services Change Order(s) be approved and/or ratified as presented.

CONSTRUCTION

26. APPROVAL OF AMENDMENT #6 TO THE ARCHITECT'S AGREEMENT FOR THE NORTH COUNTY TECHNICAL CENTER PROJECT
Description
The scope of work for this amendment shall include the cost of basic design fees through 100% construction drawings for Phase 1A and Phase II.  The total cost of this amendment will include actual design fees and will be adjusted accordingly once the construction GMP for these two (2) phases is established.  The cost for this amendment shall not exceed $1,809,418.81.  Funds for this amendment are available through the project budget account.

Recommendation
That Amendment #6 to the agreement dated 10/4/2005 with Schenkel Shultz Architecture for the North County Technical Center project be approved as presented.

27. RATIFICATION OF AMENDMENT #7 TO THE ARCHITECT'S AGREEMENT FOR THE NORTH COUNTY TECHNICAL CENTER PROJECT
Description

The scope of work for this amendment shall include the cost of preliminary basic design fees for Phase III.  The total cost of this amendment will include actual design fees and will be adjusted accordingly once the construction estimate for this phase is established.  The cost of this amendment shall not exceed $13,667.00.  Funds for this amendment are available through the project budget account.



Recommendation
That Amendment #7 to the agreement dated 10/4/2005 with Schenkel Shultz Architecture for the North County Technical Center project be ratified as presented.

28. APPROVAL OF RANKING OF ARCHITECTS/ENGINEERS FOR THE NORTH PORT HIGH - EXPANDED DINING PROJECT
Description

The scope shall include design and construction administration for the referenced project.  The construction budget is estimated to be $900,000.00.  The added facility shall be designed for an approximate total of 5,000 square feet, to be located on both sides of the existing dining room.  This project shall also include two (2) new serving lines.  On 9/30/2008, the Professional Services Selection Committee (PSSC) met to select an architect/engineer for this project.  The PSSC has ranked them in accordance with Board policy.  The project budget is approximately $1,200,000.00.  Funds for this project are available in the capital budget account.



Recommendation
That the ranking of architects/engineers for the North Port High School - Expanded Dining project be approved as presented and the Director of Construction Services be authorized to attempt negotiations with the top-ranked firm.

Description

30. APPROVAL OF ARCHITECT'S CONTRACT FOR THE TOLEDO BLADE ELEMENTARY SCHOOL - RENOVATION PROJECT
Description
The scope shall include design and construction administration to renovate the HVAC system including new chiller, thermal energy storage system, chilled water piping, air side systems, HVAC controls, lighting and electrical distribution at the referenced campus.  The scope also includes painting, replacement of flooring, fire alarm system upgrade, and low volgate systems revisions.  Also included is site restoration, and demolition and relocation of portable buildings.  On 10/7/2008 (Item #51), the School Board authorized negotiations with this company.  On 10/8/2008, the Director of Construction Services and two (2) members of the Professional Services Selection Committee (PSSC) met with a representative of TOTeMS Architecture, Inc. and successfully negotiated a contract for this project.  The contract amount is as follows:  the basis services fee shall be 8.4% of construction costs, which are estimated to be $5,500,000.00, which produces an estimated fee of $462,000.00.  The contract also includes an allowance of  $44,400.00 for additional services, which may or may not be required.  The estimated fee and additional services figures produce a total contract amount of $506,400.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The project budget is approximately $7,000,000.00.  Funds for this project are available in the capital budget account.

Recommendation
That the architect's contract for the Toledo Blade Elementary School - Renovation project be approved as presented.

31. APPROVAL OF CONSTRUCTION MANAGER'S CONTRACT FOR THE TOLEDO BLADE ELEMENTARY SCHOOL - RENOVATION PROJECT
Description
The scope shall be to provide construction management services for the Toledo Blade Elementary School - Renovation project.  On 10/7/2008 (Item #52), the School Board authorized negotiations with the top-ranked firm.  On 10/8/2008 the Director of Construction Services and two (2) members of the Professional Services Selection Committee (PSSC) met with a representative from P.J. Hayes, Inc. (d/b/a Tandem Construction) and successfully negotiated a contact for this project.  This contract covers the pre-construction and bidding services portion only for this project.  The contract for construction will be negotiated separately at a later date.  This contract amount is $40,000.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The project budget is approximately $7,000,000.00.  Funds for this project are available in the capital budget account.

Recommendation
That the construction manager's contract for the Toledo Blade Elementary School - Renovation project be approved as presented.

32. APPROVAL OF UPDATE #3 TO THE 2008/2009 ANNUAL CERTIFICATION OF PROFESSIONALS FOR CONSTRUCTION RELATED SERVICES
Description
The recommended professionals have submitted annual request for certification by the School Board to provide professional construction related services for Sarasota County School Board projects.  These submissions are in accordance with School Board Policy #7.71.  The initial list was Board approved 7/22/2008 (Item #88).  The newly added firms are identified, on the enclosure, at the end of the initial listing and are in bold print.  Upon Board approval, the pertinent data from these submissions will be incorporated to the existing list.

Recommendation
That Update #3 to the 2008-2009 Annual Certification of Professionals for Construction Related Services be approved as presented.

33. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES CHANGE ORDER(S)
Description

FINANCE

34. APPROVAL OF GENERAL FUND BUDGET AMENDMENT NUMBER FIVE AND CAPITAL PROJECTS FUNDS BUDGET AMENDMENT NUMBER SIX
Description
The Charter School distribution of State funds has always gone through the General Operating Fund.  The State has always had a formula to distribute both Charter School Capital and F.E.F.P. funds through the Operating Fund.  Effective with last school year, the State now wants the Capital allocation to go through the Capital Fund with a transfer to the Operating Fund.  The attached budget amendments reflect this change.

Recommendation
That the General Fund Budget Amendment Number Five and the Capital Projects Funds Budget Amendment Number Six be approved as presented.

SCHOOL BOARD RULES

35. ADOPTION OF SCHOOL BOARD POLICY 8.391, VEHICLE/SCHOOL BUS IDLING
Description

This policy was written in accordance with the State of Florida's newly adopted idling policy.



Recommendation
That the School Board of Sarasota County adopt Policy 8.391, Vehicle/School Bus Idling.

36. ADOPTION OF SCHOOL BOARD POLICY 7.512, TAX SHELTERED ANNUITIES AND CUSTODIAL ACCOUNTS
Description

Due to regulatory changes imposed by the Internal Revenue Service (IRS), which go into effect January 1, 2009, the new IRS regulations require more administrative flexibility than the current School Board rule allows.  Therefore, the rule must be streamlined and supplemented by written guidelines that can be periodically amended to keep pace with the ever changing regulatory environment.



Recommendation
That the School Board of Sarasota County adopt Policy 7.512, Tax Sheltered Annuities and Custodial Accounts.

Description
This School Board policy describes the authorization and process for use of AED's (Automatic External Defibrillators) at each district work site in accordance with Florida Statute 768.1325.

Recommendation
That the School Board of Sarasota County authorizes the advertisement of Policy 3.25, on AED's (Automated External Defibrillators).

The Calendar year 2009 group medical insurance rates for Blue Cross Blue Shield of Florida will increase an average of 5% after the adoption of the negotiated medical plan design changes.  The rate increase is a result of our group claim experience and medical trend (inflation), which has been running 10% to 12%.  Aon Consulting and the district's Risk Manager reviewed all the renewal underwriting assumptions and negotiated with Blue Cross Blue Shield of Florida to arrive at the requested average 5% rate increase.  Following the adoption of the plan design changes and the elimination of the dependent medical premium subsidy adopted in 2006, the cost to the district for the 2009 calendar year is estimated to decrease by $1,254,193 which is
-3.64%.



Recommendation
That the School Board of Sarasota County approves the renewal of the four district sponsored medical insurance plans from Blue Cross Blue Shield with an average rate increase of 5% for calendar year 2009 as presented.
